Tomorrow’s Santa Clara City Council and Stadium Authority meeting is headlined by a closed session on the litigation between the City and 49ers.
The 49ers have reported to the media that their “final and best offer” is on the table. Their “best” offer is really the “worst” for the City according to a comprehensive analysis by the San Francisco Chronicle this weekend that former director of the Santa Clara University’s Markkula Center for Applied Ethics Dr. Tom Shanks called “Funny Money.”
Stand Up for Santa Clara is circulating a petition to make the meeting open to the public and have independent experts review the numbers.

Four months ago. SUDS JAIN put Lisa Gillmor on notice (his own text to Becker) that she would be held responsible for the efforts of Robert Haugh James Rowen and Burt Field to team up. Haugh has never discussed anything with James Rowen. They exprssed virtual dislike of each other. Burt Field by Scott Herhold’s published writings is a well known independent.
Is Jain losing it???
Is tomorrow’s closed session for discussion of the state of the litigation or will there be a binding vote on acceptance of the 49ers’ settlement offer?
It is appropriate for there to be a closed session to discuss the state of litigation. Discussion would involve appraisal of the city’s position, chances, and strategy. This cannot be public because it allows the other side–the 49ers–to know what the city thinks is its position, chances, and strategy.
But a vote on the 49ers’ settlement offer must be public. Discussion leading up to the vote must be public. And there must be public commentary before such a vote.
The council can take any action they want in closed session. It’s listed as active litigation. No public session is required, except to announce any action taken in closed session. Members of the public can speak prior to the Council convening to closed session.
We don’t know if a vote to accept the 49ers’ offer will occur. That’s up to the Council as a whole.
