It’s been 17 months since Santa Clara Councilman Anthony Becker was indicted for felony perjury.  But in 40 days, jury selection starts for his trial on October 28.

Becker allegedly leaked a 2022 Civil Grand Jury report to the 49ers (a misdemeanor) and then lied about it to the Grand Jury (a felony). 

Becker will have to appear in the South County Courthouse in Morgan Hill.  According to sources following the case, the San Jose facility was too busy and Becker had successfully used multiple maneuvers to delay his trial.

The opening statements for the trial may begin a few days later, around Halloween. Superior Court Judge Javier Alcala will preside.

Becker initially waived his right to a speedy trial and has remained on the City Council despite numerous calls for his resignation and concerns about how he has received special treatment by the judicial system.

During that time, Becker voted on numerous 49er-related issues including settling two lawsuits that favored the team and cost Santa Clara taxpayers millions of dollars.

He also joined his 49er Five colleagues in personally attacking the Grand Jury for their 2024 reports about Santa Clara.

A few weeks ago, Becker offered a guilty plea to two misdemeanors so he could try to stay out of prison if convicted.  

But the District Attorney’s office turned it down since it looks like they have a strong case. Becker could face up to four years in prison if found guilty. 

Becker also filed for re-election to the City Council and will be on the November 5 ballot, surprising many in the community. 

Becker’s trial is expected to end with a jury decision right around Election Day.
