Judge Again Denies Convicted Felon Anthony Becker’s Request to Get Devices Back

Former Santa Clara Vice Mayor and convicted felon Anthony Becker has again been denied the return of his laptops and cellphones seized by the Santa Clara County District Attorney’s Office.

Judge Javier Alcala rejected Becker’s request during a June 12 court hearing. Becker also asked, as an alternative, for access to files stored on the devices. That request was also denied.

The devices were seized as part of Becker’s criminal case. Becker was convicted of felony perjury in 2024 for leaking a Grand Jury Report to the 49ers and lying about it.

Deputy District Attorney Jason Malinsky argued that the case is not over because Becker has appealed. The DA’s Office wants to retain the devices in case there is a retrial. 

Malinsky also argued that future improvements in technology could allow investigators to gather additional evidence from the devices.

Becker’s attorney, Deputy Public Defender Chris Montoya, argued that Becker needs access to the devices and files to find work. Becker told the court that he needs access to reels, writings and other files related to his TV and film work.  

Becker briefly worked for a local community television station for a brief period of time over five years ago.

The DA’s Office argued that Becker already had access to extracted files turned over to his attorney. 

Becker also asked for the return of devices belonging to his husband. Those devices were also seized under a search warrant, though Becker’s husband was never charged with a crime.

Judge Alcala denied both requests.

  1. My life has gotten so much easier in knowing what to do, and who to support when it comes to living and raising children here in Santa Clara California.

    Anything (Anyone), the 49ers want to support, I am against it (Them).

    I just know now, that no group of people have less concern for us as residents of Santa Clara than the 49ers or anyone or anything they are affiliated with.
    So call me simple, but…..
    They say Stand Up…. I Sit Down.
    They say turn right, I turn left.
    They want me to run, I just walk.

    Can they turn it around, of course they can. Will they? In my opinion it’s not even a topic of discussion, why would it?
    Greed is Greed. How much is enough? All I know is to them, “Everything will still never be enough”.
    Look at their track record with every City except Green Bay and that should tell you everything about the NFL.
    Not the case with every other Pro Sports program. Those groups have learned how to work with the Cities to really try and make them better.
    “Win / Win” seems to be their goals, sadly all we have in our town is this one NFL franchise.
    Go Niners…. please, and I mean, really just Go…..

  2. And to think he was just a aew votes short of being our current mayor. What a disaster that would have been. The only reason Becker came so close to winning is the backing of the 49ers who wanted their puppet employees. They poured hundreds of thousands of dollars into his campaign. With our new mayor’s race in just a few months The 49ers will soon be flooding our social media and mailboxes pushing their hand picked mayoral candidate/puppet, of course with input from our 49er friendly city manager city attorney and city council.
