Clerical Error in Santa Clara City Councilmember Suds Jain Recall Forces Restart, Ten Day Delay

The Suds Jain recall campaign will have to restart its process.

“The bad news is we found a clerical error,” said David Kertes, who lost his campaign to Jain last year and is leading the recall.   

“The good news is everyone is still committed to recalling Jain because of excessive spending, failed leadership, and lack of ethics.”

Kertes originally gathered 80 signatures from District Five residents to start the petitioning process. That’s 20 more than legally required.

According to Kertes, all original signers have agreed to re-sign the corrected document by this weekend.

Jain will have to be served papers again. 

“This setback will cost us about ten days, said Kertes. “Once the city clerk approves the documents, we have 120 days to gather a minimum of 2,055 signatures.”

  1. Yes, continue the recall effort.

    Suds argument that he has never committed a crime is pathetic, because he has sold out this city and its residents to the 49ers a number of times. That alone is the most disrespectful crime a council member could commit. Also, Robert you should highlight who the 49er 5 are meeting with at that organization. Take a look at the councils calendars and you can see this for yourself.

    These are the outsiders that are controlling the city and our council members. These are also the people spending millions of dollars to get idiots like Suds and Kevin into council.

  2. Why is the continued presence of Suds Jain on the City Council an anathema to the progress of the Mission City?

    Tolstoy wrote that despite the movement of history, the movement of historical figures seems to be continued rotations in the same circle.

    Despite my three or four points of disagreement with Mayor Gillmor, she still receives my great support? Because Lisa is dedicated to the welfare of the city. Her desire has always been what is best for Santa Clara. Gillmor treats every person speaking before the Council as the most important person in the room.

    Jain has NO INTEREST in the welfare of Santa Clara’s. NONE.

    To refuse to admonish Park for using the gavel to embarrass Kirk Vartan was reprehensible. Vartan was speaking as a member of the publuc. His right to do so was violated. Jain did nothing. If Jain would allow a aggressive activist like Kirk to be mistreated, who is to say what Jain would do to a person who lives on Buckingham who addresses the Council for the first time?

  3. Robert, thanks for the factual article. The other article that came out from another source was a poorly written hack job full of errors from a wannabe journalist.

  4. “Clerical error” (?)

    Please illuminate what the clerical error was.

    Was it a “comma” rather than a “period?” Minor typographical errors ought to be forgiven, unless the 49er 5 Government Machinery is picuyane or de minimus. If so, “dotting the I’s and crossing the T’s” is evidence that Santa Clara Government hates its citizens in favor of their “rich” paychecks. I do not want to believe that.

    So I ask, please let us know that that the clerical error was valid and NOT some vendetta with Sud’s minions.

      I campaigned heavily against Pat Nikolai for years.

      But I actually like the guy.

      I do.

      If I saw Nikolai talking to Mayor Gillmor at an event, I would shrug and just accept it.

      People do.

    • Hello, This is a great question. We had two misspellings of names that needed to be entered on the Signature page (Two blank copies needed to be given to the city clerk and the proof of publication (We had the proof of publication)). I did not catch the misspelled names on the first review. Another set of eyes found it on Sunday and we made the corrections. I believed this was not an issue, since I thought we had one more day. I was incorrect and the end date was on Monday and not Tuesday. This is my fault and I have since made the corrections. I worked from Last Thursday to Saturday to get the 80 signatures once again. We are good and moving forward.

  5. Mr. Haugh, once again, thanks for doing what you are doing for all of us here in Santa Clara.
    Very much appreciate the lone voice of reason here.
    Sadly our City is facing some really difficult questions, and only time will tell if we are able to survive what is coming at us.
    The next 12-18 months will be a challenge for sure.
    Not sure if the “Risk / Reward” is balanced as it should be, and I still believe our City is at potential serious risk if this is not quickly set right.
    Just my opinion, obviously others may think differently.

  7. It seems that David Kertes has a profound misunderstanding of the power of a single City Councilmember to take action or to spend money. I invite him to have coffee with me so I can explain this too him. I’m surprised that his strong supporter, Mayor Gillmor, has not explained how things work to take action on the council. I have never been charged with doing anything illegal nor have I been censured or admonished by the City Council.

    THE OFFICER’S ANSWER TO THE NOTICE OF INTENTION TO RECALL PER CA ELECTION CODE SEC. 11023 (2024)
    I’m honored that the voters of District 5 placed their trust in me once again last November. My family has called the Old Quad home since 1999, and for more than two decades I’ve worked to strengthen our community. From getting CERT trained, serving as a Neighborhood Watch captain, and hosting National Night Out gatherings, to volunteering with the Old Quad Residents Association at Easter Egg Hunts, Picnics in the Park, and historic home tours. I’ve always rolled up my sleeves for our neighborhood. I’ve held more than 20 open community meetings to hear concerns of residents.

    I’ve fought hard for fiscal responsibility. Together, we eliminated deficits, restored reserves, and passed a business license tax that added $6 million annually to the city’s general fund. I helped pass the first infrastructure bond since 1959, funding critical projects including roads, modern fire stations, and the ISC rebuild. I pushed for Levi’s Stadium weeknight concerts, each generating about $1 million for the city.

    I’ve worked on pressing social issues—launching the Homelessness Task Force, securing deeper levels of affordability in housing projects, and building Santa Clara’s first community garden.

    • Having coffee with Suds Jain is akin to having tea with the Mad Hater. Jain is the greatest example of a politician impressed with himself beyond reason.

    • Suds Jain, You had five votes whenever you needed them. This means if you would have stood up and fought for the residents of District 5, you could get almost anything done. Saying you cannot get five votes is a bad excuse.
